Due to the current COVID-19 pandemic, Solicitors for Older People Scotland (SOPS) are offering free advice on Power of Attorney, to support older individuals who may face challenges around illness, care, or long-term social isolation.
Powers of Attorney can be used to deal with all legal and financial matters; the person appointing the Attorney need not have lost legal capacity to make decisions, and just is unable to deal with these matters for a period.
Older couples regularly appoint each other as Attorneys; however, during COVID-19, SOPS advises that this may not be practical, as one partner may become infected and the other is then effectively quarantined.
Many older people will qualify for legal aid to have Power of Attorney put in place, and SOPS can support this process by phone (instead of home or office visits).
