The consultation on the draft regulations under the Carers (Scotland) Act 2016, and the consultation on the draft Carer’s Charter, are now open for responses.
Carers (Scotland) Act 2016 Draft Regulations Consultation
The purpose of this consultation is to seek views on draft regulations being made under the Carers (Scotland) Act 2016, and to ensure that the final regulations are appropriate, fit for purpose and well informed by stakeholders (including those who will be involved in delivering the new provisions of the Act). The contents of the draft regulations are a culmination of work which has been informed by the Parliamentary Bill process and consistent stakeholder engagement.
The consultation focuses on draft regulations on:
- the specific circumstances in which an adult carer support plan and young carer statement must be reviewed
- what type and level of information is to be included in short breaks services statements, and to set out when and how these are to be published and reviewed by the appropriate authorities
Scottish Government are also seeking views on their proposed approach to clarifying, through statutory guidance, that support to enable carers to follow leisure pursuits is an option under section 24 of the Act (Duty to provide support).
The deadline for responses is Sunday 24th September.

Draft Carer’s Charter Consultation
Section 36 of the Act requires Scottish Ministers to prepare and publish a Carers’ Charter (“the Charter”), setting out the rights of carers in or under the Carers (Scotland) Act 2016. The Charter cannot and does not create any new rights or alter any existing rights.
The Charter is intended to provide a summary of these rights in a readily accessible and understandable format for both young and adult carers alike. There is also a requirement to consult with carers and carer representatives and to lay the Charter before the Scottish Parliament.
This consultation is to determine if this draft Charter is fit for purpose and whether or not a revised Charter will be published in due course.
The deadline for responses is Sunday 22nd October.
